<title>Ohio Introduces New Features for Owners and Claimant Reps</title>

<description><![CDATA[The Ohio Division of Unclaimed Property has introduced a new system aimed at helping property owners and claimant representatives (finders). 
<br /><br />
“Finders and claimants are now able to search and claim funds directly on our website, in addition to uploading documents and checking the status of a claim,” Ohio’s announcement said. “Additionally, Finders will be able to register as a new finder, reciprocal finder, or renewal finder as well as upload documents with the new functionality.”

<title>Delaware Updates Holder Handbook, Addresses Foreign Property Questions</title>

<description><![CDATA[<p>On Feb. 26, 2025, the Delaware Office of Unclaimed Property issued an updated <span style="text-decoration: underline;"><a href="https://unclaimedproperty.delaware.gov/docs/DE_Holder_Manual_2025.pdf" target="_blank">Unclaimed Property Holder Handbook</a></span>.
    Especially noteworthy is a clarification of the state’s position on the treatment of foreign property:</p><p style="margin-left: 40px;">
<br />
<em>“The enactment of Senate Bill 267 on August 15, 2024, clarified and confirmed foreign 
addressed property that is reportable to, or specifically exempted by a foreign country is 
not reportable to the State. Please note this applies to reports filed and property remitted after the effective date of this legislative change. For more information, see 12 Del. C. §§
1130(7) and 1141.<br />
<br />
 “The State has received numerous inquiries about the applicability of this amendment,  
including requests that the State provide comprehensive legal guidance to holders for
every foreign jurisdiction. The State reasonably expects that holders who operate in 
foreign jurisdictions are appropriately aware of their regulatory and other compliance
requirements, including their unclaimed property reporting obligations, in the foreign jurisdictions in which they operate. It is not an unreasonable expectation that holders are aware of or obtain legal guidance regarding the unclaimed property laws of the jurisdictions in which they operate, as a cost of doing business internationally.<br />
<br />
“The State has never required the reporting of foreign property when that property has been previously reportable to a foreign jurisdiction. The State expects holders to comply with their legal obligations by reporting property to the appropriate jurisdiction, or applying this exemption only to ‘property … specifically exempt from custodial taking under the law of this State or the state or foreign jurisdiction of the last-known address of the owner.’<br />
<br />
“To the extent that foreign address property is not reportable or not exempted by a foreign country, such property is reportable to the State of Delaware by holders legally domiciled or incorporated in Delaware. If a country has no unclaimed property law, or is silent as to a particular property type, there is no specific, or express, exemption for a property type,  
and therefore, the property should be reported according to Delaware law and the Priority Rules.<br />
<br />
“At the present, the State does not have reciprocal agreements with any other jurisdiction. 
All property with an address in any other state of the United States, the District of Columbia, or any territory or possession of the United States, must be reported in 
compliance with that jurisdiction’s unclaimed property laws.<br />
<br />

<description><![CDATA[<p>The New York Office of Unclaimed Funds recently announced it plans to convert to Kelmar Abandoned Property Systems (KAPS) for reporting unclaimed funds in 2025. With this change, only reports formatted in the <a href="https://unclaimed.org/reporting-software-and-naupa-file-format/" target="_blank"><span style="text-decoration: underline;">National Association of Unclaimed Property Administrators (NAUPA) standard file format</span></a> will be accepted. After the conversion to KAPS, watch for these enhancements:</p>
<ul>
    <li>Use the Manual Online Reporting tool to enter your report on our website.</li>
    <li>Download updated reporting materials and forms.</li>
    <li>Preview the NAUPA III standard file format.</li>

<title>Department of Labor Announces Unclaimed Retirement Benefits Policy </title>

<description><![CDATA[On Jan. 14, 2025, the U.S. Department of Labor’s Employee Benefits Security Administration today announced an&nbsp;<a href="https://www.dol.gov/agencies/ebsa/employers-and-advisers/guidance/field-assistance-bulletins/2025-01" target="“_blank”"><span style="text-decoration: underline;">enforcement relief policy</span></a>&nbsp;to
    provide retirement plan fiduciaries with an option to help manage small benefit amounts owed to individuals who cannot be located.
<br /><br />
Under the policy, the department will not take action under the fiduciary duty provisions of the&nbsp;<a href="https://www.dol.gov/agencies/ebsa/laws-and-regulations/laws/erisa" target="“_blank”"><span style="text-decoration: underline;">Employee Retirement Income Security Act</span></a>&nbsp;against
    fiduciaries who transfer entire benefit payments owed to missing participants of $1,000 or less to state unclaimed property funds, if certain conditions are met.
<br /><br />
“This policy gives fiduciaries an additional option for handling small outstanding retirement benefit payments owed to missing participants and beneficiaries,” said Assistant Secretary for Employee Benefits Security Lisa M. Gomez. “Our goal is to reunite
    participants and beneficiaries with their retirement benefits and this new policy will support fiduciaries’ ability to choose this option when prudent and provide individuals with another option for finding benefits that may be owed to them.”
<br /><br />
To qualify for relief under this policy, fiduciaries must meet the conditions set forth in the policy, including:
    <ul>
        <li>Meeting conditions designed to protect the interests of the missing individuals.&nbsp;</li>
        <li>Adopting best practices for locating missing participants and beneficiaries.&nbsp;</li>
        <li>Selecting state unclaimed property funds that meet the minimum standards outlined in the policy.</li></ul>

<title>Delaware Updates Securities Reporting Instructions</title>

<description><![CDATA[<p>Effective immediately, Delaware has recently changed its custodian for the reporting of securities to Wells Fargo Advisors. Any holders reporting and remitting securities to Delaware should follow the updated instructions that are available in the state's&nbsp;<span style="text-decoration: underline;"><a href="escheat.holderquestions@delaware.gov" target="_blank">Holder Reporting Guide</a></span> (page 40), and, in part, below:
<br /><br /> Five days prior to delivery of securities, holders must email their intent to deliver to Delaware’s custodian via an Excel Document containing the issue name, CUSIP, ticker symbol, number of shares, and the delivering party’s DTC participant
number and/or delivering party’s information. Please email the Excel list to <span style="text-decoration: underline;"><a href="mailto:Delawarecustody@kelmarassoc.com">Delawarecustody@kelmarassoc.com</a></span> and <span style="text-decoration: underline;"><a href="mailto:escheat.holderquestions@delaware.gov">escheat.holderquestions@delaware.gov</a></span>.
<br /><br /> All reported shares should be delivered via ACATS using the following instructions:<br /> Wells Fargo Clearing Services, LLC<br /> ACATS Participant #0141<br /> Reference: State of Delaware Main Account<br /> Account # 3294-9051<br /><br /> Worthless or Non-transferable securities should not be reported until the securities become
transferable or have gained value. Non-transferable securities with value should be liquidated by the holder, and then reported and remitted as the cash proceeds.<br /><br />By way of further reminder, holders reporting securities should have controls and procedures
in place to ensure the following, as the state has observed a recent increase in these issues in securities reports:</p><ul>
<li>Pay or deliver property “contemporaneously” when reporting (12 Del. C. sec. 1152(a) (recently amended by S.B. 267));</li>
<li>Report accurately only the securities intended to be reported;</li>
<li>Do not report or remit worthless or non-transferable securities, until they become transferable or have gained value;</li>
<li>Liquidate nontransferable securities with value, and report and remit the cash value;</li>
<li>Do not report or remit OFAC-restricted property;</li>
<li>Transfer shares only to the State’s Main securities account and do not create or transfer shares to “house” accounts; and</li>
<li>Timely respond to all follow-up requests by OUP staff to resolve reporting issues.</li>

<description><![CDATA[On July 24, 2024, Rhode Island General Treasurer James Diossa announced that Rhode Island’s official unclaimed property website has a new address: <a href="https://FindRIMoney.gov" target="_blank"><span style="text-decoration: underline;">FindRIMoney.gov</span></a>. The previous address, FindRIMoney.com, will redirect users to the new website during this transition.
<br /><br />
The website provides unclaimed property reporting resources for holders, as well as tools for owners to search for and claim their property. 
<br /><br />
“The transition to a .gov domain further assures Rhode Islanders recovering unclaimed property can trust the website is official and secure,” said General Treasurer Diossa. “I would like to thank Carol Aguasvivas and the unclaimed property team for leading this website update effort, allowing for a smooth transition between domain names so that everyone looking to access the money that is rightfully theirs can do so comfortably.”

<description><![CDATA[<p>The West Virginia Unclaimed Property Division recently issued the following updated guidance regarding reporting of safe deposit box contents:
   <br /><br />
West Virginia Unclaimed Property Division is making to the reporting and processing of safe deposit box contents effective July 1, 2024, to better serve the public and attempt to reunite as many items as possible with their rightful owner. As new
    contents are received by our office, we will attempt reunification for a period of one year without disposing of any items located within the box, as received. Please make note of the following important changes which will affect your bank.
    <br /> <br /> Going forward, contents should be sent to the state in whole without disposing of any items within the box including miscellaneous papers. Once you have inventoried the contents of the box, please ensure the contents are placed in a
    security sealed bag with the owner information and inventory sheets located on the outside of the bag. The accurate inventory and notation on the bag will be vitally important as contents will be returned to the owner exactly as they are turned over
    to the state. If inventory sheets or owner information are not on the outside of the bag and clearly marked, the contents will be returned to you to make the necessary corrections. Guidance regarding firearms and controlled substances have not changed
    and are noted below.
    <br /> <br /> Firearms and Controlled Substances: The holder must contact a local law enforcement agency if firearms or controlled substances are found in safe deposit boxes. Firearms must NOT be sent to the West Virginia State Treasurer’s Office
    by the bank. The local law enforcement agency should confiscate any firearms, controlled substances including drug paraphernalia, and any live ammunition. DO NOT send these items to the West Virginia State Treasurer’s Office. Include contact information
    on the inventory sheets explaining that these items were found but turned over to the local law enforcement agency. The law enforcement agency will turn them over to the Treasurer’s Office per their procedures, if required.

<description><![CDATA[<p>Dear Holder or Stakeholder:</p> <p>As a holder or stakeholder within the unclaimed property securities industry, the Arkansas Auditor of State’s office (the “Office” or “State”) would like to inform you that the Unclaimed Property Reporting Booklet (the “booklet”) was recently updated.&nbsp; <br /><br />There are updates that may affect the way you can transfer shares into the State’s custody; therefore, the Office wanted to place special emphasis on some of the most notable changes. &nbsp;The updated instructions may be found on pages 8 through 11 of the booklet, linked <a href="https://linkprotect.cudasvc.com/url?a=https%3a%2f%2fwww.auditor.ar.gov%2freport-property%2freporting-instructions%2f&amp;c=E,1,UyV5ThiqCnqMXeB1L23NsvTbbU1-D2sqEjGZ_kzqpoCNG88Ts9pnmpsmptzpuVQZzhfoHNyDyZNVsllIrRrSVe_wY7x_kxXWsxucbaa0lk_PyYdlO0wW9XU,&amp;typo=1">here</a> for your review.&nbsp; </p> <p>Recent changes to the booklet include:<br /><br /></p> <ol style="margin-top: 0in;" start="1"><li style="margin-left: 0in;"><span>A report of unclaimed property must be received before the Office will agree to accept any securities transferred to the State, with an exception for shares held within an individual retirement account which is subject to federal tax withholdings. </span></li><li style="margin-left: 0in;"><span>Shares transferred into the State’s account without prior approval may be rejected or DK’d.</span></li><li style="margin-left: 0in;"><span>Description of worthless securities updated, see booklet.</span></li><li style="margin-left: 0in;"><span>The following steps must be completed prior to reporting shares held in an IRA account: </span></li></ol> <p style="margin-left: 1in;">1) Follow federal guidelines for tax withholdings as directed by the IRS. </p> <p style="margin-left: 1in;">2) Send prior notice as directed above indicating that the shares are held in an IRA account. </p> <p style="margin-left: 1in;">3) Complete the transfer of shares into the State’s account. </p> <p style="margin-left: 1in;">4) Submit your report of unclaimed property. <p>The article identifies three significant dilemmas:</p>
<ol><li>Property value is a key factor in unclaimed property due diligence, but cryptocurrencies are notoriously volatile.</li><li>Some states don’t accept escheated cryptocurrencies, and liquidating them can harm property owners.</li><li>Complying with new laws regarding virtual currencies and unclaimed property is difficult.</li></ol>

<title>Important Change to Delaware’s March 1 Reporting Procedures</title>

<description><![CDATA[<p>The state of Delaware is in the process of transitioning its banking services to J.P. Morgan Chase (JPMC), and the Office of Unclaimed Property (OUP) is one of the first agencies to participate in this transition. Holders of unclaimed property should
    be aware that wire and ACH payment instructions have changed in advance of the March 1, 2021, annual reporting deadline.</p>
<p>&nbsp;</p>
<p>While previous payment instructions will remain active during the transition, holders planning to remit payments by wire or ACH should contact OUP’s Receipts &amp; Wires Unit to obtain the new payment instructions by email (preferred)&nbsp;<a href="mailto:DOF_holderreceiptsquestions@delaware.gov"><u>DOF_holderreceiptsquestions@delaware.gov</u></a>&nbsp;or

<title>Nebraska Announces Holder Website/Software Conversion </title>

<description><![CDATA[<p>The Nebraska Unclaimed Property Division recently announced upcoming changes to its unclaimed property software and website. As such, the unclaimed property website will not accept report submission from Aug. 17-24. Other noteworthy changes:</p>
<ul>
    <li>Nebraska will no longer accept HDE encrypted files.</li>
    <li>Holder payments will be available at the time of report submission.</li></ul>
<p>Following is Nebraska's notice to holders:</p>
<p>&nbsp;</p><blockquote style="margin: 0 0 0 40px; border: none; padding: 0px;"><i>
The Nebraska Unclaimed Property Division will be completing a software conversion before the end of the month of August. Our office will no longer be accepting HDE encrypted files. Other report requirements, including a properly formatted NAUPA file,
    have not changed. While the software conversion is taking place, the Unclaimed Property Reporting website will not be accepting report submissions. This functionality will be down on our website from August 17th to August 24th.</i></blockquote><blockquote style="margin: 0 0 0 40px; border: none; padding: 0px;"><i><br>You will see a new look to our website at the time of our software conversion…</i></blockquote><blockquote style="margin: 0 0 0 40px; border: none; padding: 0px;"><i><br>Over the last year, the Unclaimed Property Division has been using the URL, NebraskaLostCash.gov. This URL will remain the same post conversion.</i></blockquote><blockquote style="margin: 0 0 0 40px; border: none; padding: 0px;"><i><br>Holder reports are required to be submitted online, either through our website, NebraskaLostCash.gov or https://sovos.com/products/tax-reporting/unclaimed-property-reporting/upexchange/. This is not a new requirement, but serves as an important reminder.
    Reports will not be accepted on a CD or by paper.<br></i></blockquote><blockquote style="margin: 0 0 0 40px; border: none; padding: 0px;"><i>&nbsp;</i></blockquote><blockquote style="margin: 0 0 0 40px; border: none; padding: 0px;"><i>With the launch of our updated website, the Nebraska Unclaimed Property Division will now offer online holder payments at the time you submit your report. This new feature will allow holders to submit reports through NebraskaLostCash.gov, then the website
    provides the option to complete a payment through an ACH debit transaction. This will allow holders submitting reports online and making an ACH payments to report completely paperless. Your report is not required to be notarized, so no paperwork will
    need to be mailed.</i></blockquote><blockquote style="margin: 0 0 0 40px; border: none; padding: 0px;"><i><br>If a holder chooses not to pay electronically and plans to send a paper check, the confirmation page from your online report submission should be printed and mailed with the check for the report. Checks sent without a confirmation page could result in
    a delay in processing the report.</i></blockquote><blockquote style="margin: 0 0 0 40px; border: none; padding: 0px;"><i><br>November 1st is the holder reporting deadline for non-life insurance holders.</i></blockquote><blockquote style="margin: 0 0 0 40px; border: none; padding: 0px;"><i><br></i><p><i>Any questions related to holder reporting should be addressed to nst.upholderreporting@nebraska.gov.</i></p></blockquote>
