ABA Incorporates UPPO Suggestions into Model Act Draft

UPPO was pleased to learn that the American Bar Association’s Unclaimed Property Subcommittee has incorporated the majority of comments submitted by UPPO into its latest Model Unclaimed Property Act draft.


“It was evident that the ABA thoroughly reviewed and considered the comments provided by UPPO,” said Freda Pepper, a member of the UPPO Government Relations and Advocacy Committee’s ABA Workgroup. "The ABA not only incorporated language and ideas suggested by UPPO but also took the time to provide a reasoned response when UPPO's comments were not incorporated into its draft."


The ABA model act is intended to serve as an alternative to the Revised Uniform Unclaimed Property Act (RUUPA), approved by the Uniform Law Commission last year. Because the Act is still in development, UPPO has not decided whether to formally support ABA’s model act over RUUPA. However, UPPO always welcomes the chance to provide comments and input on behalf of members when such opportunities arise.


The ABA Unclaimed Property Subcommittee is planning to finalize its model act for consideration by state legislatures by the end of 2017.
