INDIANA LAW CHANGE EFFECTIVE DATE CORRECTION
The new three-year dormancy periods will first apply to Indiana annual reports due November 1, 2011, not this November
Prepared by John Biek and Marcella Easly, Co-Chairs of GRAC Awareness and Advocacy Committee
Becky Yuan, Indiana State Unclaimed Property Division Director, has informally confirmed that the Division’s website incorrectly states, "Effective July 1, 2010 the statutory holding period for certain properties has changed from five (5) years to three (3) years. The amended holding periods must be reflected in the report of holders due NLT November 1, 2010.” The Indiana annual reports due this November are to include property items that were presumed abandoned as of June 30, 2010, the day before the new three-year dormancy periods took effect. For this reason, the five-year dormancy periods will still apply to annual reports due November 1st of this year. The annual reports due November 1, 2011 will need to catch holder reporting up to the new three-year dormancy periods. If you have any questions, you may email Becky at: byuan@atg.in.gov
